These terms apply when you use our website or engage fortunegreen ("we", "us", "our") for web design, development, SEO, consulting, hosting, care plans or other services. By submitting a payment, signing up to a plan, accepting a quote or using our services, you agree to these terms on behalf of yourself and your business. If a signed proposal or quote says something different, the proposal or quote applies for that project.
We work for you as an independent contractor.
fortunegreen is based at 35 Baden Road, Bickley WA 6076. ABN: 21 836 250 092.
1. Quotes and projects
- Website, development, SEO and consulting work is quoted individually. Quotes are valid for 30 days unless they say otherwise.
- A quote sets out what we'll deliver. Work outside that scope, including extra changes, pages or features, is charged separately, and we'll tell you before we start it.
- We may ask for a deposit before starting a project, with the balance due before the site goes live, unless your quote says otherwise.
- Timeframes are estimates. Most delays come from waiting on content, feedback or access, so we rely on you to provide these promptly.
2. Access to your website
Where we need access to your website to do the work, you authorise us to access, and make changes to, the files, directories and database of your website, including with any third-party hosting provider. You also authorise us to install WordPress plugins needed for maintenance and security.
3. Your responsibilities
You agree to:
- give us accurate information and the content, images, logins and approvals we need, on time
- make sure you have the right to use any content, images, logos or materials you give us
- check your website and let us know about any errors or problems promptly
- keep your own passwords and accounts secure, and tell us if you think they've been compromised.
You're responsible for the content on your website and for making sure it complies with the law, including consumer, privacy and advertising laws. We don't accept responsibility for the content of websites we build, manage, maintain or host.
Changes made by you or others
Once your WordPress site is finished, you can update your own pages unless we've agreed otherwise. If anyone other than fortunegreen or our subcontractors changes the site and it damages the design or stops pages displaying or working properly, repairs are charged at our hourly rate of $110 per hour, with a one-hour minimum.
4. Payments
- All prices are in Australian dollars and exclude GST unless stated otherwise. Prices on our website may change without notice, but changes won't affect work you've already accepted a quote for.
- When you become a client, you authorise us to charge the payment method you've given us for invoices for the services we provide.
- Invoices are due within 14 days unless they say otherwise.
- We may pause work or services, including hosting, if an account is more than 30 days overdue. We'll always contact you first.
5. Hosting, care plans and subscriptions
This includes Premium Hosting, Managed Plugin Updates and our Gold and Platinum care plans.
- Billing: plans are billed monthly in advance through Stripe and renew automatically until cancelled.
- Changes and cancellation: you can upgrade or downgrade at any time. You can cancel a monthly plan at any time after your first month (30 days) of service, from the client portal or by contacting us before your next payment is due. Cancellation takes effect at the end of your current billing period.
- Refunds: we don't give refunds for part months, or for a package or service once we've started work on it, unless we've agreed otherwise in writing. This doesn't affect your rights under the Australian Consumer Law.
- Payment method: to change your card, update it in the client portal or contact us before your payment is due.
- Monthly time: time included in a plan, such as 30 minutes of changes each month, must be used within that month and doesn't roll over. Work beyond your included time is charged at our hourly rate of $110 per hour, less any discount your plan includes.
- Price changes: we may change plan prices with at least 30 days' notice by email.
- Moving on: if you cancel hosting, we'll give you a copy of your website files and database, and help you move to another host. Moving help may be charged at our hourly rate.
6. Updates, backups and security
We take care with updates, backups and security monitoring, but we can't guarantee that a website will meet every requirement, or will run without interruption, errors, data loss, viruses, hacking or other security problems. Plugins, themes and third-party services are made by other companies and can change or stop working without notice. If something goes wrong, we'll work with you to fix it as quickly as we reasonably can, including restoring from a backup where needed.
We recommend you keep your own copy of important content, such as product information, images and documents.
7. Third-party services
Your website may rely on third-party products and services, such as WordPress, plugins, themes, domain registrars, payment gateways, email services and platforms like Shopify or Squarespace. Their own terms and fees apply, and we're not responsible for their availability, changes or pricing.
Domain names registered for you are registered in your name or your business's name.
8. Ownership
- Once you've paid in full, you own the website content and design we create specifically for you.
- We keep ownership of our own tools, code, templates and know-how, and give you a licence to use them as part of your website.
- Third-party software, such as WordPress, plugins, themes, fonts and stock images, stays subject to its own licence.
- We may show your website in our portfolio and case studies unless you ask us not to.
9. SEO and results
We follow good practice to help your website be found on Google and by AI tools, but search rankings and AI answers are controlled by other companies and change constantly. We can't guarantee any particular ranking, amount of traffic, number of enquiries or sales.
10. Liability
Nothing in these terms excludes, restricts or changes any rights you have under the Australian Consumer Law that can't be excluded.
Otherwise, to the extent the law allows:
- your website and its functions are provided "as is" and "as available", and you use them at your own risk
- we're not liable for indirect, incidental, special or consequential loss, including lost profits, lost savings, loss of data or business interruption, however caused
- our total liability for any claim relating to our services is limited to the amount you paid us for those services in the 12 months before the claim, or, at our choice, supplying the services again.
11. Ending our services
We may refuse service to any person, business or website with offensive, obscene, hateful or malicious content, or for any other reasonable reason.
Either of us can end a project or ongoing service by giving written notice. If a project ends early, you pay for the work done up to that point. We may suspend or end services straight away if an account is seriously overdue, or if a website is used for anything illegal, harmful or that puts our servers or other clients at risk.
12. Privacy
We handle your personal information in line with our privacy policy.
13. Changes to these terms
We may update these terms from time to time. The latest version will always be on this page. If we make a significant change that affects an ongoing plan, we'll let you know by email.
14. Governing law
These terms are governed by the laws of Western Australia, and any disputes will be handled by the courts of Western Australia.
15. Entire agreement
These terms, together with any quote or proposal you've accepted, are the entire agreement between us. Any other changes must be agreed in writing by both of us.
